Nursing Home Wrongful Death

When a resident dies as a direct result of nursing home negligence or abuse, the victim’s family may be entitled to monetary compensation for their loss. Even though the resident may have been ill, the premature death of a family member caused by a nurse or staff member’s inability to provide the proper care is inexcusable and punishable by law.

Nursing home residents face many challenges as they usually are unable to care for themselves. However, this does not mean that they should be subject to negligent or inadequate treatment when they have entrusted their life to a nursing home. Residents of nursing homes and assisted living facilities are entitled to be treated fairly, properly and with respect.

Wrongful Death Lawsuit

Determining if a patient’s death was caused by nursing home negligence requires an investigation by qualified attorneys and experienced medical experts. More often than not, the death certificate will not provide the evidence needed in order to prove that negligent care was responsible for a patient’s death. For example, the death certificate may list the cause of death as heart failure when in reality the real cause was malnutrition and dehydration caused by nursing home neglect which caused the patient’s heart to weaken, and eventually stop functioning.

Nursing home wrongful death lawsuits are claims brought by the surviving family members against a specific doctor, hospital or nursing home/assisted living facility. The laws regulating who is eligible to file a claim and what benefits may be obtained will vary from state to state. Gathering the evidence needed to successfully win a wrongful death case is a difficult, lengthy and expensive process. Therefore, it is important to have a qualified attorney on your side fighting to protect your family.
